"content": "Chị Nguyễn Thúy Hạnh, người khởi xướng quỹ 50k giúp đỡ các tù nhân lương tâm, vừa bị bắt tại Hà Nội.<br />-----------------<br />Sáng ngày 7-5-2021, vào khoảng 8g00 sáng, công an cùng các lực lượng phục vụ đi kèm, có trên 20 người đã đến nhà chị Nguyễn Thúy Hạnh, ập vào khám xét và đọc lệnh bắt, đưa chị đi.<br />Theo những người ở chung cư cho biết thì cuộc bắt giữ diễn ra trong vòng khoảng hơn một tiếng, sau đó giải chị Nguyễn Thúy Hạnh đi nhanh chóng, dường như để tránh bị dân chúng chung quanh để ý và tụ tập.<br />Cuộc bắt giữ diễn ra vào thời điểm anh Huỳnh Ngọc Chênh, chồng chị, có việc phải ra khỏi Hà Nội, còn chị Hạnh ở nhà thì chỉ có một mình.<br />Chị Nguyễn Thúy Hạnh được biết đến là người khởi xướng Quỹ 50k, tức 50.000 VNĐ, nhằm giúp tù nhân lương tâm qua đóng góp tự nguyện của cộng đồng. <br />Đỉnh điểm căng thẳng giữa chị Hạnh và công an Hà Nội, là việc chị liên tục lên tiếng đòi phía công an phải giải tỏa số tiền 500 triệu đồng phúng điếu, từ mọi nơi gửi về qua tài khoản Vietcombank của chị, để giúp cho gia đình cụ Lê Đình Kình, vốn bị thảm sát trong cuộc đột kích bất minh của công an vào rạng sáng ngày 9-1-2020 ở Đồng Tâm. Công an lấy cớ đây là tài khoản nhằm tài trợ cho khủng bố, nhưng kết thúc vụ xử Đồng Tâm, lại không có kết luận nào từ tòa án xác định về nguồn quỹ này là \"tài trợ khủng bố\" cả. Why Democracy....?<br /><br /> Written in Vietnamese by Nguyễn Vũ Bình <br /> Translated by Dương Thị Phương Hằng <br /><br />In my perspective, if today a study on the Egyptian peopleʼs way of thinking is complete, could you tell how many of them knew and understood the term of freedom or democracy? What did they know about their basic human rights, or their civil and constitutional rights? How could the people engage in developing and establishing a democratic system? Who and what branch of government could protect all human rights and its peopleʼs rights? In what ways and by what means could the peopleʼs rights be protected?... etc... <br /><br />Do you think that every single citizen is the main subject in the developing and implementing of the democratic system or protecting and benefiting from it?<br /><br />If those questions are combined donʼt you think that there would be a huge gap, a critical disadvantage in developing and establishing the democratic system not only for Egypt, but also for other countries that have changed their political and social systems or those that are about to change them, do you?<br /><br />Letʼs review every single step leading to the process of developing and establishing the democratic system in those countries, lately. The need of a Constitution requires the invitation of well known professionals and professors coming from the most developed countries in the world to help write the Law of the land: the Constitution, the registration of all political active parties, the introduction of a voting schedule, the announcement of getting peopleʼs opinions on drafting the Constitution.... <br /><br />Indeed, all steps leading to the process of developing and establishing the democratic system in those countries as described above were only to create the “ body or skeleton “ of a democratic system. That should be done as a matter of fact, but it had no more meaningful values or less because the “ soul “ in that body was lacked. <br /><br />What was the “soul” of a democratic system? It was the civic engagement of the people in developing, implementing and protecting the democratic system by fully understanding and being conscious about knowledges regarding all the issues relating to liberty and democracy. <br /><br />To get there, we need to have different approaches with different strategies as what has been done recently in the world. I meant to present my thought on the process for the people to engage in the development and establishment of the democratic system relating to the political change in many countries from different social system converting to the democratic system. ( I have incubated these thoughts since I wrote a book on Democracy for my people ).<br /><br />Knowledge about peopleʼs basic rights and civic engagement are the most important tools for the democratic system to be successful as a whole. Again, people must be involved in the developing, implementing and protecting the democratic system. However, It would take a long time for them to be conscious about what they have been missing and why their rights have been stolen. That can not be done overnight. That is the reason why a legal system must be established first, with an open structure which can be changed to the best interest of the people through times. So, the people are empowered when they take the opportunity to engage their dreams and knowledge in the process of developing such a structure as the time comes. With such an open structure, a legal system must consist of the following factors: <br /><br />1. A democratic system with decentralized powers ( between local, states and federal government ). The decentralization of powers would guaranty either all traditions, and diversities of each local region or lessen in size to the maximum all conflicts caused by different political parties. The peopleʼs welfare that a democratic system with decentralized powers would bring in is equal developments on every domain; it would reduce all bureaucratic paper works that a centralized system has always required; it would eliminate all negative influences of military defense over the national engagement in politics ..... <br />2. A small central government with a minimum power to fulfill its goal in order to sustain the national duties. Its main responsibility is to represent the nation, to maintain the unification of the people, to build a strong military defense and armed force (military and police), to install well structure local and federal courts to resolve any dispute between people in the communities. And, its other important duty is to encourage, to support and to urge the process of developing the democratic system to function properly at the local government as the ground of all civic engagements. As a matter of fact, the local government beginning at the districts and cities level has the power to manage all economic issues, all social and cultural standards or activities within the parameters of the Law. <br />3. The affirmation and development of democracy must be done at the local level. It is very important to affirm and develop democracy at the local level because geographically, it is the smallest unit to begin with. At the same time, every citizen can be part of it. Naturally, the content of democracy must be tied to the peopleʼs living conditions at the local level, so they can actually engage in building up the government system, and the legal system with the Courts to protect their human rights. All other political activities towards democracy at the higher level (such as states and federal) should aim to open a broader avenue to support and create opportunities to assure the demand for establishing the democratic political activities at the local level. The peopleʼs rights are to be measured with their civic engagement as a whole body of communities at the local level. <br />4. The installation of Human rights Courts must be done at all governmental levels. This is a legal system that would guaranty peopleʼs ability to protect and defend themselves for their individual civil and constitutional rights. This is also the most crucial factor in the content of democracy, in the establishing of a system of democracy, in the methodology of organizing democracy. This is the core, the nucleus of a structure that can be self better off in any democratic system. Once this structure is built with all necessary characteristics and features, democracy by itself will be able to overcome all obstacles, and challenges to self better off. Given two reasons to interpret that, I see: <br />- a. The peopleʼs rights have always been the subject of being violated and abused anywhere, anytime and under any circumstances because: <br />* The legal system has not been served the peopleʼs civil and constitutional rights due to a complex process that should be acquired through learning and experience. What did they know about their basic human rights, or their civil and constitutional rights? How could the people engage in developing and establishing a democratic system? Who and what branch of government could protect all human rights and its peopleʼs rights? In what ways and by what means could the peopleʼs rights be protected?... etc... \n\nDo you think that every single citizen is the main subject in the developing and implementing of the democratic system or protecting and benefiting from it?\n\nIf those questions are combined donʼt you think that there would be a huge gap, a critical disadvantage in developing and establishing the democratic system not only for Egypt, but also for other countries that have changed their political and social systems or those that are about to change them, do you?\n\nLetʼs review every single step leading to the process of developing and establishing the democratic system in those countries, lately. The need of a Constitution requires the invitation of well known professionals and professors coming from the most developed countries in the world to help write the Law of the land: the Constitution, the registration of all political active parties, the introduction of a voting schedule, the announcement of getting peopleʼs opinions on drafting the Constitution.... \n\nIndeed, all steps leading to the process of developing and establishing the democratic system in those countries as described above were only to create the “ body or skeleton “ of a democratic system. That should be done as a matter of fact, but it had no more meaningful values or less because the “ soul “ in that body was lacked. \n\nWhat was the “soul” of a democratic system? It was the civic engagement of the people in developing, implementing and protecting the democratic system by fully understanding and being conscious about knowledges regarding all the issues relating to liberty and democracy. \n\nTo get there, we need to have different approaches with different strategies as what has been done recently in the world. I meant to present my thought on the process for the people to engage in the development and establishment of the democratic system relating to the political change in many countries from different social system converting to the democratic system. ( I have incubated these thoughts since I wrote a book on Democracy for my people ).\n\nKnowledge about peopleʼs basic rights and civic engagement are the most important tools for the democratic system to be successful as a whole. Again, people must be involved in the developing, implementing and protecting the democratic system. However, It would take a long time for them to be conscious about what they have been missing and why their rights have been stolen. That can not be done overnight. That is the reason why a legal system must be established first, with an open structure which can be changed to the best interest of the people through times. So, the people are empowered when they take the opportunity to engage their dreams and knowledge in the process of developing such a structure as the time comes. With such an open structure, a legal system must consist of the following factors: \n\n1. A democratic system with decentralized powers ( between local, states and federal government ). The decentralization of powers would guaranty either all traditions, and diversities of each local region or lessen in size to the maximum all conflicts caused by different political parties. The peopleʼs welfare that a democratic system with decentralized powers would bring in is equal developments on every domain; it would reduce all bureaucratic paper works that a centralized system has always required; it would eliminate all negative influences of military defense over the national engagement in politics ..... \n2. A small central government with a minimum power to fulfill its goal in order to sustain the national duties. Its main responsibility is to represent the nation, to maintain the unification of the people, to build a strong military defense and armed force (military and police), to install well structure local and federal courts to resolve any dispute between people in the communities. And, its other important duty is to encourage, to support and to urge the process of developing the democratic system to function properly at the local government as the ground of all civic engagements. As a matter of fact, the local government beginning at the districts and cities level has the power to manage all economic issues, all social and cultural standards or activities within the parameters of the Law. \n3. The affirmation and development of democracy must be done at the local level. It is very important to affirm and develop democracy at the local level because geographically, it is the smallest unit to begin with. At the same time, every citizen can be part of it. Naturally, the content of democracy must be tied to the peopleʼs living conditions at the local level, so they can actually engage in building up the government system, and the legal system with the Courts to protect their human rights. All other political activities towards democracy at the higher level (such as states and federal) should aim to open a broader avenue to support and create opportunities to assure the demand for establishing the democratic political activities at the local level. The peopleʼs rights are to be measured with their civic engagement as a whole body of communities at the local level. \n4. The installation of Human rights Courts must be done at all governmental levels. This is a legal system that would guaranty peopleʼs ability to protect and defend themselves for their individual civil and constitutional rights. This is also the most crucial factor in the content of democracy, in the establishing of a system of democracy, in the methodology of organizing democracy. This is the core, the nucleus of a structure that can be self better off in any democratic system. Once this structure is built with all necessary characteristics and features, democracy by itself will be able to overcome all obstacles, and challenges to self better off. Given two reasons to interpret that, I see: \n- a. The peopleʼs rights have always been the subject of being violated and abused anywhere, anytime and under any circumstances because: \n* The legal system has not been served the peopleʼs civil and constitutional rights due to a complex process that should be acquired through learning and experience.
