Dotie Joseph (D – Miami-Dade) wants you to have to run away and retreat before defending your home or yourself (or another)!!<br /><br />Florida HB 6049 filed on 12/05/2019 wants to remove your ability to defend yourself in your home (Strikes down the entire Florida State Statute 776.013 - Home protection; use or threatened use of deadly force; presumption of fear of death or great bodily harm.—), and will remove the parts of the Justifiable Use of Force in Defense of a Person Statute (776.012) that refer to being able to stand your ground and not have to retreat before using deadly force to defend yourself.<br /><br />This is one of the most dangerous bills I have seen filed this year so far. It literally is trying to take a huge step backward in the self-defense world. You used to be expected to retreat before trying to use deadly force to defend yourself. If you used deadly force you had to be able to explain why you couldn’t just have run away. Imagine the lawsuits brought against you when they say “while you could have just run away”. That is where she wants to go back to,<br /><br />It strikes the entire 776.013 statute down and wants to remove “A person who uses or threatens to use deadly force in accordance with this subsection does not have a duty to retreat and has the right to stand his or her ground if the person using or threatening to use the deadly force is not engaged in a criminal activity and is in a place where he or she has a right to be.” from F.F.S. 776.012<br /><br />Why would you want to remove those statutes and protections for all the citizens in Florida? This does not just affect firearms owners, but every citizen in Florida no matter what they defend themselves with! I can only think of a few reasons and those make me shiver with fear for our legislative process. The only people that would benefit from this change would be burglars, criminals, and people bent on harming or killing you. What kind of legislation is that? Polsky<br /><br />“Sale, Transfer, or Storage of Firearms: Revises requirements for storage of firearms; provides criminal penalties if minor access stored firearm & uses it in specified ways; revises definition of \"minor\"; requires seller or transferor of firearm to provide specified information; provides immunity for certain providers of information; revises standard for adults & minors to be criminally negligent in storage of firearms in certain circumstances.”<br /><br />Effective Date: October 1, 2020<br />Last Event: Now in Criminal Justice Subcommittee on Monday, November 25, 2019 4:09 PM<br /><br />This bill is designed to place new requirements for storage and securing the firearm while it is in your home. It requires you to lock up and secure any firearm in your home unless you are carrying it on your person or it was within immediate reach of you. No more storing firearms in different locations of your home in case of emergencies, no more having firearms out or in your bedroom in case you need it for protection. If you do store a firearm that is in noncompliance and a minor gets the firearm whether they break into your home or not and they use it and anyone is harmed you are guilty of a felony.<br />In addition, this bill would require that all firearms dealers post certain signs in their stores telling you what is illegal and what is unsafe. They also have to provide you with rules of safe handling storage and use of firearms. And then a list of other things such as nomenclature and descriptions of various types of firearms, the responsibility of firearms ownership, a list of locations at which handguns are prohibited, and so on.<br /><br />Here is an excerpt from the proposed bill that you will find interesting:<br />“(3)(a)1. An adult who stores or leaves a loaded firearm within the<br />reach or easy access of a minor commits, if the minor obtains<br />the firearm and uses it to inflict injury or death upon himself<br />or herself or any other person, a felony of the third degree,<br />punishable as provided in s. 775.082, s. 775.083, or s. 775.084.”<br /><br />Now you notice it doesn’t say that you’re not held liable if the minor breaks into your home and takes the firearm. So regardless of whether or not the minor obtains the firearm from your home if you have a loaded firearm for self-protection in your home and a minor breaks into your homes feels it and uses it to commit a crime and injure someone with or kill someone you are going to be held liable.<br /><br />Now I don’t know about you, but I don’t think it’s right for the state to tell me how I am to take care of my firearms inside my own home. Basically, what this is, that the government is trying to tell you that you are not responsible enough and adult enough to decide how to care for your own property. So they have to tell you what you have to do in order to safely handle and store a firearm in your own home even if you don’t have any children living in your home.<br /><br />You need to contact the members of the criminal justice subcommittee and make your voices heard that you do not support this bill and do not want the government intruding into your home and telling you how to do things inside of your own house.<br /><br />Here is a list of the members of the criminal justice subcommittee that you can email and make your voices heard:<br /><br />Chairman Rep. People know we are buying stuff for the holidays and there is no shortage of people out there that are evil and want to take what you worked hard to obtain. <br /><br />The most precious item you have though isn't stuff - it is your KIDS - stuff can be replaced your children can't. <br /><br />SO, if your kids are of age to be responsible enough to be left home alone then they are responsible enough to be trusted in self defense with the best tool available (a firearm). Honestly the media scary AR-15 is probably the easiest firearm for them to wield properly, (or the AR-15 pistol variant). <br /><br />Train them in the safe operation, how to get to the tool quickly, and how to adequately deploy it to save their life. <br /><br />Evil does not wait for you to get home and sadly in many cases evil pieces of shit hope your teen age daughter is home alone. I know we all want our kids to remain innocent to the horrors of the world but the harsh reality is that evil is out there and it loves to shatter that innocence. <br /><br />So show the most open act of love you can give your child - give them the ability to protect themselves when mamma bear and papa bear aren't around. Stewart (D - Orange County)<br /><br />Prohibiting the importing into this state, or the distributing, transporting, transferring, selling, or giving within this state, of large-capacity magazines; providing criminal penalties; prohibiting the possession of large-capacity magazines; providing exceptions; specifying circumstances in which the manufacture or transportation of large-capacity magazines is not prohibited, etc.<br /><br />This bill would make it a FELONY to possess any magazine that holds over 10 rounds. It also requires that if you have \"large-capacity magazines\" you have to \"register\" them within a year of this becoming law if it does. Not like that would be any kind of firearm registry or anything, which is illegal. SMH.
