I’m not a lawyer, but as a rank-and-file GC poster, I can break it down into three key screenshots. The current version of the US Equality Act, which has been passed by the House but not the Senate, does these objectionable things:</p><ol><li><p>Whenever “sex” appears, it replaces it by “sex (including sexual orientation and gender identity).” Rather than being distinct protected categories, both sexual orientation and gender identity are claimed to be part of the protected category “sex.” Already on our way to conflating “sex” with “gender.”</p></li><li><p>Single-sex spaces are defined instead to be single-gender-identity spaces. Having a single-sex-space becomes discriminatory, because you are denying people with the “right” gender identity access to what the Act claims is in fact actually a single-gender-identity space.</p></li><li><p>When “sex” is a bona fide employment qualification (think rape shelters for example), the Act claims gender identity is now the relevant category rather than sex.</p></li></ol><p>The effect of these points is that “sex” may as well no longer be on the list. Gender identity always supersedes it. That’s why “sex” is said to be erased in the Act.</p>",
