In 2021, for example, the transport sector missed its statutory targets by three million tons.\n\nAccording to the law, the responsible minister must present an emergency program within a few months with measures \"that ensure compliance with the sector's annual emission levels for the following years.\" The Greens and FDP interpret the sentence differently.\n\nFor the Scientific Service, there is no doubt: the relevant passage in the law does not just mean making up for the previous year's emission levels. Rather, it means \"the more far-reaching goal\" of \"ensuring compliance with the corrected emissions reduction path for subsequent years.\"\nOnly in this way would an emergency program \"do justice\" to the claim of the Climate Protection Act and \"not only attempt to compensate for an annual emission quantity of the reporting year that has already been exceeded, but also already respond to expected missed targets of subsequent reporting years.\" The authors cite several legal commentaries in support of this position.\n\n",
